Terms of Service

These Terms of Service ("Terms") govern your use of EarthScope, a product of Pezora Software Limited, a company incorporated in England and Wales (company number 17260237), whose registered office is 167–169 Great Portland Street, Fifth Floor, London, W1W 5PF ("EarthScope", "we", "us"). By signing up for EarthScope you agree to these Terms. If you do not agree, do not use the service.
1. Your account
The entity that signs up for EarthScope (the "Customer") is the contracting party under these Terms. The administrator who completed sign-up has authority to bind the Customer and to add or remove users. EarthScope is not liable for actions taken by users authorised by your administrator.
You are responsible for keeping login credentials secure and for all activity on your account. Notify us immediately at [email protected] if you suspect unauthorised access.
2. Acceptable use
You agree not to:
- Upload data you do not have the right to use or share.
- Reverse-engineer, scrape, or systematically extract data from the service.
- Attempt to circumvent rate limits, authentication, or access controls.
- Use the service for any unlawful purpose.
3. Data ownership and licence
All data you upload to EarthScope remains your property. You grant EarthScope a limited, non-exclusive, royalty-free licence to store, process, and transmit your data to provide the service and to improve and develop EarthScope, including through anonymised research. EarthScope will not sell your data to third parties.
If you choose to donate your data to EarthScope when deleting your account (via the opt-in checkbox presented at account deletion), you grant EarthScope a perpetual, irrevocable, worldwide licence to use that data for research and product improvement purposes.
4. Billing
Plans bill monthly in advance, exclusive of VAT. VAT will be added where applicable.
Price changes. You will be notified by email at least 30 days before any price increase takes effect. The notification will state the new price, the date it takes effect, and — where we offer a choice of plan to move to — clear instructions on how to select a different plan before the change date. If you take no action before that date, you will be automatically moved to the new price or the default plan we have designated. You may cancel your account at any time before the change takes effect to avoid the new price.
If a payment fails, your account access will be suspended within 3 days of the failed payment. The billing page remains accessible during suspension to allow you to resolve payment. If payment is not made within 14 days of suspension, EarthScope may terminate your account in accordance with Section 6.
No refunds are issued for unused portions of a monthly billing period, including upon cancellation or termination. Access continues until the end of the current paid period following cancellation.
5. Service availability
We aim for high availability but make no SLA guarantee on standard plans. Enterprise customers may negotiate an SLA separately.
6. Termination
EarthScope may suspend your account immediately and terminate it with 48 hours' written notice for material breach of these Terms.
You may delete your account at any time from your account settings. Following deletion you will have 7 days to export your data. After this window your data will be deleted in accordance with our Privacy Policy retention schedule.
7. Indemnification
You agree to indemnify and hold harmless Pezora Software Limited, its officers, directors, and employees from any third-party claims, damages, or costs (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) data you upload that infringes a third party's rights; or (c) your use of the service in violation of applicable law.
8. Liability
EarthScope is provided "as is". Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; or (b) fraud or fraudulent misrepresentation.
Subject to the above, EarthScope's total liability to you under or in connection with these Terms is limited to fees paid by you in the 12 months preceding the event giving rise to the claim. EarthScope is not liable for loss of profits, loss of data, loss of goodwill, or any indirect or consequential loss.
9. Force majeure
EarthScope is not liable for any failure or delay in performance caused by events outside our reasonable control, including infrastructure outages, natural disasters, acts of government, or third-party service failures.
10. Changes to these Terms
We may update these Terms. We will notify active customers of material changes by email at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
12. General
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EarthScope relating to your use of the service.
- No waiver: Failure by EarthScope to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision on any subsequent occasion.
